Rental Terms and Conditions

These Terms explain how rentals with LuxuryCarsCuba work. They apply to chauffeur service and to self driving of vehicles in our fleet. The rental contract you sign at pickup will control if there is any inconsistency with this page. For questions or a written copy, email contact@luxurycarscuba.com.

Eligibility and Documents

  • Age. Minimum age is 21 years. Sports category of the REX trademark requires a minimum of 25 years. Maximum age is 80 years.
  • Identity. Valid passport or updated identity document is required.
  • Driver license. For self driving you must present an original physical driver license. Digital licenses are not accepted. For chauffeur service a driver license is not required.
  • Status. Clients must not be listed as Non Grata or unpleasant customer by suppliers or authorities.
  • Waiver tiers. The waiver of responsibility differs for clients aged 21 to 24 and 75 to 80 when compared with clients aged 24 to 70.

Scope of Service

LuxuryCarsCuba provides premium car rental and chauffeur service through its own fleet and through selected licensed partners in Cuba including Cubacar, Havanautos and REX where appropriate. The reserved category is guaranteed. A specific make or model is subject to availability at pickup.

Booking and Contract

  • Holder. The person named on the reservation is the contract holder. A client may hold only one active rental in the same period. Contract is signed in person at the start of service and a service voucher must be presented.
  • Copies. Keep the copy of the contract in the vehicle at all times and present it if requested by authorities or supplier staff.
  • Duration limit. A contract may run for a maximum of 30 days including extensions. After 30 days a new contract must be opened if service continues.
  • Right of admission. LuxuryCarsCuba may refuse service if requirements are not met or if there is abusive behavior or appearance under the influence of alcohol or drugs.

Charges and Payment

  • Rental price. Calculated per 24 hour day by category and season at the current public rate when service begins. Extensions are subject to availability and rates in force at the time of the extension.
  • Liability waiver. Charged per day by category and age tier. The online quote applies the tier for 25 to 75 years. If the holder is 21 to 24 or 76 to 80, the difference is paid at contract opening.
  • Airport office supplement. A one time charge applies when pickup is at an international airport office.
  • New fleet supplement. A one time charge may apply for the first rental of vehicles newly added to the fleet.
  • Fuel. Vehicle is delivered with prepaid fuel by category at booking. Fuel is purchased during rental at service centers. Unused fuel is not refundable.
  • Drop fee. Returning to a different office may incur a drop fee. If delivered to an office other than the agreed office, the drop fee for that destination plus a fifty percent penalty will be charged.
  • Currency and methods. Prices are expressed in USD. Collection and return operations in Cuba use international cards authorized to operate in the country. National clients may pay with local MLC cards where allowed. Additional charges during service use the same methods.
  • Deposits. A security deposit is required. The amount depends on category and will be confirmed in the written quote.

Insurance and Waiver

  • Coverage. The waiver offered by suppliers protects the holder in case of damage to the vehicle, accidents, fire, theft and harm to third party property or persons, subject to contract terms.
  • Police report. A police action document is required in all cases. Failure to present required documents may void coverage.
  • Exclusions. Loss or breakage of tires and audio equipment is not covered. Use by a non registered driver voids coverage.
  • Period. Coverage applies from the contract start time until the contract end time. For accidents reported soon after expiry, supplier procedures apply as stated in the contract.

Additional Drivers

  • Limit. Up to two additional drivers may be added. They must meet all eligibility requirements.
  • Role. Additional drivers may drive the car but cannot open or close contracts, request extensions or receive returns.
  • Charges. Additional driver fees are charged from the date of inclusion until contract settlement.

Pickup Return and Extensions

  • Show up. Arrive at the office named on the reservation at the agreed date and time. If delayed, inform us in advance. If there is no contact within five hours after the reservation time, the booking may be marked as no show and charges will apply.
  • Twenty four hour day. Rental days are counted in periods of twenty four hours from pickup.
  • Extensions. To extend the rental you must visit the nearest office to formalize the extension before the return time. If you pass the return time without extension you lose the benefits of the waiver for any incident.
  • Late return. When more than five hours pass after the return time a full extra day may be charged at the current public rate.

Cancellations and Refunds

  • Sixty to thirty days before pickup. Refund of the full amount less a charge of twenty five percent of the total payment.
  • Thirty to fifteen days before pickup. Refund of the full amount less a charge of fifty percent of the total payment.
  • Fifteen to zero days before pickup. Refund of the full amount less a charge of one hundred percent of the total payment.
  • Form of request. After payment, requests for cancellation or modification must be made in writing by email.
  • No show. If the client does not appear on the start date the reservation is treated as a no show with no refund.
  • After start. After the service begins there is no refund for unused days.
  • Refund method. Refunds are made only to the same card used for the reservation. If a bank transfer is used, related bank fees are deducted from the refundable amount.

Vehicle Use Rules

  • Registered drivers only. If an unregistered driver is detected the vehicle may be withdrawn and the holder may lose remaining days and waiver benefits. The holder and the unregistered driver may be marked as Non Grata.
  • Road use. Use the car on public roads that are open and safe. Off road use, racing, competitions and illegal activities are not allowed.
  • Care of the car. Do not alter the structure or fixtures. Keep keys, contract copies and documents safe. Loss or damage of keys or documents is chargeable.
  • Fuel quality. Use only suitable fuel from authorized service centers. Contaminated fuel related damage is chargeable.
  • Cleanliness. Excessive dirt, stains or smells may incur a cleaning fee.
  • Smoking. Smoking in the vehicle is not allowed.
  • Pets. Pets are allowed only with prior approval and suitable carriers. Cleaning fees may apply.

Accidents Damage and Theft

  • Immediate actions. Stop in a safe place, contact the authorities and our support line. Obtain the police report and any witness details.
  • Reports. Present the police report at settlement. Without required documents the holder may be responsible for damages.
  • Third parties. For harm to third party property or persons follow local procedures and notify us.
  • Theft. Report theft to the police and to our team without delay.

Traffic Fines and Penalties

  • Traffic fines. Parking and moving violations are the client’s responsibility. Pay fines at authorized collection offices and provide proof at settlement. Unpaid fines may be charged to the contract.
  • Administrative penalties. Extra charges may apply for dirty returns, excess passengers, transporting animals without approval, towing another vehicle, missing or damaged accessories, breach of maintenance, late return beyond the grace noted above, or placing stickers or accessories on the car without authorization.

Maintenance and Breakdowns

  • Regular service. For long rentals the vehicle may require scheduled service. Follow the instructions given at pickup for the nearest approved location. If a change of car is needed it will be organized by the office.
  • Repairs. Only supplier approved workshops may perform repairs. Unauthorized repairs are not reimbursed.
  • Replacement vehicle. If the car cannot be used due to a covered issue a replacement may be provided subject to availability and category rules.

Data and Privacy

We collect only the data needed to process the booking and operate the rental. This can include identity documents, driver license details and payment confirmations. We share data with local suppliers only for service delivery and with authorities where required by law. For a copy or correction, contact our team.

Governing Law and Disputes

These Terms and any rental contract are governed by the laws of Cuba. Any dispute will be handled by the competent courts in Havana, subject to any mandatory consumer protection rules that apply to you.
